01 Compliance Statement

Genragous complies with the Digital Millennium Copyright Act (DMCA) and all applicable intellectual property laws. We take copyright infringement seriously and respond promptly to valid notices submitted by rights holders or their authorized representatives.

🛡️ The Company claims safe harbor protections under the DMCA and is not liable for user-generated content, provided it responds appropriately to valid takedown notices.

02 Notice of Infringement Requirements

To submit a valid DMCA takedown notice, your written notice must include all of the following elements:

Identification of Copyrighted Work: A clear description of the copyrighted work you claim has been infringed.

Location of Infringing Material: Identification of the allegedly infringing material and its specific URL or location on the Platform.

Contact Information: Your full name, mailing address, telephone number, and email address.

Good Faith Statement: A statement that you have a good faith belief the use of the material is not authorized by the copyright owner, its agent, or the law.

Accuracy Statement: A statement made under penalty of perjury that the information in the notice is accurate, and that you are the copyright owner or authorized to act on their behalf.

03 Submission Procedure

All DMCA notices must be submitted in writing to our designated legal agent. Incomplete notices may not be processed. Please ensure your notice includes all required elements listed in Section 02 before submitting.

04 Counter-Notification

If you believe your content was removed in error or misidentified as infringing, you may submit a counter-notification. Your counter-notice must include:

Identification of the material that was removed and the location where it appeared before removal
A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
A statement consenting to the jurisdiction of the applicable federal court in your district
Your full name, address, phone number, email, and physical or electronic signature

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If no legal action is filed within 10–14 business days, the content may be restored.

05 Repeat Infringers

Genragous has a strict policy against repeat copyright infringers. Accounts found to have repeatedly violated intellectual property rights may be terminated without prior notice.

⚠️ The Company reserves full discretion in determining what constitutes repeat infringement and in applying appropriate enforcement actions, up to and including permanent account termination.

06 Misrepresentation

Submitting a DMCA notice or counter-notification that contains false, misleading, or inaccurate information is a serious legal matter. Any party who knowingly misrepresents that material is infringing — or that material was removed by mistake — may be held liable for:

Monetary damages suffered by the affected party
All court costs incurred during legal proceedings
Reasonable attorney fees of the prevailing party

⚠️ Only submit a DMCA notice if you have a genuine, good faith belief that your copyright has been infringed. False claims will not be tolerated.

07 Safe Harbor

Genragous operates as an online service provider and claims safe harbor protections under 17 U.S.C. § 512 of the DMCA. The Company is not liable for copyright-infringing content uploaded by users, provided that:

The Company does not have actual knowledge of the infringing content
The Company does not financially benefit directly from the infringing activity
The Company acts expeditiously to remove or disable access upon receiving a valid DMCA notice

Our safe harbor protections are contingent on our continued compliance with the DMCA's notice-and-takedown procedures. We are committed to upholding these standards.
